[03:12.73]B 1 Plumbing 9 installation

[03:17.64]We will pay for damage to any part of the plumbing installation in your home caused by freezing or bursting

[03:24.80]but not

[03:25.95]a)if the installation is outside or in an outbuilding

[03:31.51]b)loss or damage due to rust,corrosion or wear and tear

[03:39.12]c)after your home has been unoccupied for more than 30 consecutive days

[03:45.72]2 Service Pipes and Cables

[03:49.17]We will pay for accidental damage for which you are legally responsible to underground drains,

[03:55.89]pipes,cables and tanks providing services to or from your home

[04:02.44]3 Glass and Sanitary 10 Wear

[04:06.20]We will pay for accidental breakage of fixed glass in windows,

[04:10.75]in windows,in doors or in roofs,fixed ceramic 11 hobs or fixed sanitary ware 12 in your home

[04:18.22]but not

[04:19.47]a)breakage by any paying guest or tenant

[04:24.44]b)after your home has been unoccupied for more than 30 consecutive days

[04:30.71]4 Fees and Clearance 13 Costs

[04:34.55]We will pay

[04:36.04]a)the cost of architects,surveyors,consultants and legal fees

[04:43.66]but not fees for preparing any claim under this policy

[04:47.84]b)costs to clear the site and make it and the buildings safe

[04:54.14]necessarily incurred 14 with our consent in the repair or reinstatement of the buildings following damage recoverable under this section

[05:03.26]5 Local Authority Requirements

[05:06.91]We will pay the extra cost of reinstatement or repair of the damaged part of the buildings incurred solely 15 to comply with any government or local authority requirement,

[05:18.17]following damage recoverable under this section

[05:21.75]but not if such requirement had been advised to you before the damage occurred

[05:27.86]6 Alternative Accommodation and Rent

[05:32.25]We will pay in addition to any other amount recoverable under this section

[05:37.48]a)if you occupy your home

[05:40.92]the cost of reasonable alternative accommodation for you

[05:45.10]your family and domertic pets

[05:47.98]b)if your home is lent or let

[05:51.92]rent you would have received but lose

[05:54.59]while your home is unfit to live in following damage recoverable under this section

[06:00.31]Any claim payment will not be more than 20% of the sum insured by this section

[06:06.73]7 Sale and Purchase

[06:10.00]a)if you are selling your home the purchaser will have the benefit of the insurance

[06:16.40]by this section up to the date of completion provided the buildings are not otherwise insured

[06:22.82]b)if you are purchasing another private dwelling 16 your new dwelling will be insured by this section

[06:30.50]for up to three months from the date contracts to purchase are exchanged or in Scotland the date of the acceptance of offer

[06:39.46]but not

[06:40.82]i)if it is otherwise insured

[06:44.24]ii)after completion of the purchase

[06:47.85]iii)for more than 125% of the sum insured by this section.

[06:54.51]BASIS OF CLAIMS OF SETTLEMENT

[06:57.04]1 We will pay the cost incurred in reinstatement or repair of that part of the buildings

[07:04.44]which is damaged by any of the causes insured by this section without any deduction 17 for wear and tear,

[07:11.65]provided that at the time of such damage the buildings are in a good state of repair

[07:16.98]2 If the damage to the buildings is not reinstated or repaired or the buildings are not in a good state of repair then we will pay at our option

[07:28.31]a)the cost of reinstating the damage less a deduction for any wear and tear or betterment,or

[07:37.20]b)the difference between the sale value of your home in the open market immediately prior to the damage and its residual 18 value following such damage

[07:49.32]3 The most we will pay for any one claim will be the total sum insured shown in the schedule plus any amount payable 19 under paragraphs B5,B6 and B7 of this section

[08:05.41]4 The sum insured will not be reduced by a claim payment

[08:11.57]5 Any claim settlement for loss or damage will be reduced by the amount of any excess shown in the schedule

[08:20.40]YOUR LIABILITY AS PROPERTY OWNER

[08:23.35]We will pay all sums for which you become legally liable arising solely from your ownership of your home and its land,

[08:31.06]or from any private dwelling previously 20 owned and occupied by you for accidental

[08:37.15]a)death of or bodily injury to any person

[08:41.93]b)loss of or damage to material property

[08:46.21]occurring during the period of insurance shown in the schedule

[08:50.44]but not liability

[08:52.51]i)for death of or bodily injury to any member of your family or domestic staff

[08:59.27]ii)for damage to property belonging to or in the custody 21 or control of you,your family or domestic staff

[09:07.68]iii)arising from

[09:10.37]1)any profession,business or employment

[09:14.61]2)an agreement unless that liability would have existed otherwise

[09:19.65]Any claim payment resulting from one incident will not be more than £1,000,000

[09:25.50]We will also pay costs,expenses and legal fees necessarily incurred with our written consent.

[09:32.42]CLAIMS CONDITIONS WHICH APPLY TO THE WHOLE POLICY

[09:35.90]1 Notification of a Claim

[09:40.10]When you become aware of a claim or potential claim under this policy you must give us notice in writing as soon as reasonably possible

[09:49.51]2 Loss or Damage Claims

[09:53.35]For any loss or damage claim you must

[09:56.51]a)at your expense provide us with such information and evidence as we may request including written estimates and proof of ownership or value

[10:08.00]b)notify the police immediately of any loss or damage by deception,theft,attempted theft,vandalism,

[10:18.40]malicious acts,riot or civil commotion or if any property has been lost outside your home

[10:25.97]3 Liability Claims

[10:29.19]For any liability claim you must

[10:32.22]a)send us any letter,claim,writ or summons in connection with the claim or potential claim immediately it is received

[10:43.16]b)not admit,deny,negotiate or settle a claim without our written consent

[10:51.44]4 Abandonment

[10:54.16]No property may be abandoned to us

[10:57.40]5 Enforcing your Rights

[11:01.00]We may at our expense and in your name take any steps necessary to enforce your rights against any other person either before or after we pay a claim

[11:13.18]6 Other Insurances

[11:16.39]If there is any other insurance covering the same loss,damage or liability we will only pay our proportionate share

[11:26.79]CONDITIONS WHICH APPLY TO THE WHOLE POLICY

[11:29.95]1 Policy Terms and Conditions

[11:33.81]You and any other person entitled to benefit under this policy must comply with its terms and conditions

[11:43.16]2 Prevention of Loss

[11:46.27]You must take all reasonable steps to

[11:49.69]a)prevent loss,damage or accident

[11:54.76]b)maintain the insured property in sound condition and good repair

[12:01.42]3 Cancellation 22

[12:04.77]a)You may cancel the policy by giving us notice in writing and we will make a refund 23 of premium 24 paid

[12:13.65]for any unexpired period of insurance unless a claim has been made during the current period of insurance

[12:22.56]b)We may cancel the policy by sending seven days notice by letter to your last known address

[12:31.23]when we will make a refund of the premium paid for any unexpired period of insurance

[12:37.89]c)If the premium is payable by monthly instalments and payment ceases we will give you seven days notice as provided in paragraph b) above.
